Sebastian Zapeta-Calil, an undocumented migrant from Guatemala, waived his appearance in court after being indicted on first and second degree murder as well as one count of arson for the horrifying Sunday killing aboard the F train.

The first-degree murder charges carry the possibility of life without parole.

The accused killer allegedly went up to the sleeping woman, who has yet to be identified, and ignited her clothes, with videos on social media showing the accused killer fanning the flames as it engulfed her, according to officials.

He then left the subway and sat on a platform bench and was captured on the body camera of a responding officer.

That image was then posted to the public in a flier. After a few hours, three high schoolers saw him on the subway and called 911 and he was arrested.

Meanwhile, Zapeta-Calil will be formally arraigned at the state Supreme Court on January 7th, where the entire indictment will be unsealed.

The accused murderer is described as a heavy drinker by his homeless shelter friends, he also told police he was drunk on the morning of the incident and doesn’t remember what happened.
