During a Wednesday budget hearing held by the House Appropriations Committee, Miguel Cardona, the Biden administration’s secretary of education, declined to address the question of whether men and women differ physically.

In regard to the National Association of Intercollegiate Athletics (NAIA) announcement on Monday that it will be excluding biological men who identify as transgender women from participating in women’s sports, Cardona was questioned on the topic at the budget hearing.

According to the Daily Caller, during the hearing, Representative Andy Harris (R-MD) asked Cardona about the significance of Title IX before moving on to ask him about the physical distinctions between men and women.

Title IX is a federal civil rights law that shields people from sexual discrimination in educational programs and activities that are funded by the federal government.

“Would you agree that Title IX was necessary to help establish women’s sports because women can’t fairly be expected to compete on biological male teams?” Harris asked Cardona.

Cardona tried to sidestep the topic at first, but after Harris urged him not to filibuster, he acknowledged the significance of Title IX. Subsequently, Harris inquired if Cardona would concur that women and men are physically different.

“I see where you’re going with this,” Cardona began before being interrupted. After Harris asked the question again, Cardona added that he would “love to talk about how we can work together to support the students.”

Harris tried for a second time to get Cardona to discuss the physical distinctions between males and women in the context of sports.

“Mr. Secretary, do you agree that biological women are different from biological men physically?” Harris asked. “This is a simple question for an educator. You’re not going to answer. Okay.”

Cardona was also questioned over the Biden administration’s position on the NAIA’s most recent ruling during a CNN interview. In his remarks, Cardona vaguely emphasized the significance of “protecting all students and making them feel welcome, seen, and supported.”

However, Cardona failed to mention the slippery slope regarding how granting the “rights” of biological men who identify as women that wish to participate in women’s sports would take away fairness and future opportunities from women competing in their specified gender bracket.
